AN ACT relative to obtaining a certificate of title for certain trailers.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Exempted Vehicles. Amend RSA 261:3, I(j) to read as follows:
(j) Trailers with gross weight of less than 3,001 pounds, and any trailer over 3,001 pounds whose manufacturer’s model year is over 10 years old;
2 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:
This bill would exempt any trailer over 3,001 lbs., whose manufacturer’s model year is over 10 years old, from motor vehicle title requirements. The Department of Safety states in 2024 there were approximately 35,000 titles issued for trailers to which this bill would have applied to. Given the title fee that will be in place effective January 1, 2026, of $35, this would be a potential annual revenue loss of approximately $1,225,000. Also, pursuant to RSA 235:23 (“Apportionment A”), 12 percent of highway fund road toll and motor vehicle fee revenue collected is distributed to municipalities in the year following collection. Therefore, this bill would also reduce state expenditures and local revenue by approximately $147,000 in FY 2028 and beyond. Lastly, the Department states that any state expenditures attributable to this bill, mostly related to the cost for direct mailing titles, would decrease annually by approximately $27,000 per year.
Typically, bills impacting motor vehicle registration, title, or driver license laws are effective on January 1, however, this bill would be effective 60 days after passage. The amounts illustrated above represent full year estimates, however, given the effective date, year 1 of the noted impacts would likely be reduced due to timing of implementation.
