AN ACT creating an exception to the restricted uses of artificial intelligence by state agencies.

ANALYSIS

 

This bill authorizes commissioners or heads of state agencies to apply for an exception to the restricted uses for which artificial intelligence may be used by state agencies.  This bill also directs the commissioner of the department of information technology to create a procedure for processing and accepting requested exceptions, with the final decision on approval being made by the executive council.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty-Six

 

AN ACT creating an exception to the restricted uses of artificial intelligence by state agencies.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Exemptions and Exceptions.  Amend RSA 5-D by inserting after section 6 the following new section:  

5-D:7  Exemptions and Exceptions.  The commissioner or head of any state agency may request an exception to the applicability of this chapter.  Such requests shall include the state agency's purpose for needing the exception and any other information required by the department of information technology, pursuant to RSA 21-R:4, XXII.  Upon approval of the request by the commissioner of the department of information technology, the request shall then be submitted to the executive council for a final decision on approval.  

2  Procedure.  The department of information technology shall establish a procedure for commissioners or heads of state agencies to submit requests for an exception to the applicability of RSA 5-D within 30 days of this act taking effect.  Such procedure shall require the request specify a purpose for needing the exception.  

3  New Paragraph; Procedure for Requested Artificial Intelligence Exceptions; Duty to Establish Procedure.  Amend RSA 21-R:4 by inserting after paragraph XXI the following new paragraph:  

XXII.  Establish a procedure for the commissioners or heads of state agencies to submit requests for an exception to the applicability of RSA 5-D.  Such procedure shall require the request specify a purpose for needing the exception.  

4  New Section; Artificial Intelligence Exceptions; Decision Making Authority.  Amend RSA 4 by inserting after section 48 the following new section:  

4:49  Artificial Intelligence Exceptions; Decision Making Authority.  The executive council shall review requests for an exception to the applicability of RSA 5-D and determine whether an exception shall be accepted or denied.  

5  Effective Date.  This act shall take effect upon its passage.
