STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty-Six

 

AN ACT relative to reporting and transparency reports for the education freedom account program.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Education; Education Freedom Accounts.  Amend RSA 194-F by inserting after section 4 the following new section:  

194-F:4-a  Program Administration and Required Information.  

I.  The following shall apply to the authority and responsibilities of the scholarship organization under the program:  

(a)  The scholarship organization shall provide access to all types of qualifying educational expenses enumerated in RSA 194-F:2, II(a)-(o); and

(b)  Failure by a scholarship organization to provide access to every qualifying expense described in RSA 194-F:2, II(a)-(o) shall disqualify a scholarship organization from participation in the program.

II.  The scholarship organization responsible for administering and implementing RSA 194-F:2 shall provide information in the form of electronic data, reports, and written and verbal testimony as may be requested by education freedom savings account legislative oversight committee, the state board of education, the department of education, or the parent and education service provider advisory commission.  The scholarship organization shall provide the requested information within 45 business days.  

III.  Pursuant to RSA 194-F:2, II, the scholarship organization shall collect and summarize education freedom account expense information by category and by education service provider.  Collected information shall be published no later than 45 business days after the state releases funds. A final cumulative report shall be published annually after all funds have been released.  The data used and reports produced shall be published on the website of the scholarship organization.  The report shall be available in a standard sortable electronic format.  No personally identifiable information shall be used or accessible in the data or report posted electronically.  

IV.  The scholarship organization shall provide the department of education with timely access to eligibility and enrollment data and any additional information requested by the department to facilitate its monitoring and compliance with its contracts and other relevant laws and rules.  

2  Effective Date.  This act shall take effect 60 days after its passage.
