STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty-Six
AN ACT relative to annual reporting on accessory dwelling unit construction and use.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subparagraphs; Office of Planning and Development. Amend RSA 12-O:53-a, II by inserting after subparagraph (b) the following new subparagraphs:
(1) Prepare an annual report on the number of accessory dwelling units, as defined by RSA 674:71, being built in the state and whether they are attached or detached, occupied by owners, tenants, or vacant, utilized as short-term rentals, as defined in RSA 48-A:1, converted from preexisting structures in accordance with RSA 672:72, meet the definition of "affordable” or “workforce housing,” as defined in RSA 674:58, and meet the definition manufactured housing, as defined by RSA 674:31; and
(2) Compile any other information that will help the state and its political subdivisions plan for growth and development.
2 Effective Date. This act shall take effect July 1, 2026.

METHODOLOGY:
This bill requires the Department of Business and Economic Affairs to prepare an annual report on accessory dwelling units (ADUs). The report must include information on type, occupancy, affordability, conversion status, use as short-term rentals, and other data that will assist state and local planning efforts.
The Department states the bill would substantially increase its research, data collection, and reporting responsibilities, particularly for the Division of Planning and Community Development. The Department does not currently have the staffing capacity to compile ADU data from all 234 cities and towns and 22 unincorporated areas or to create and maintain a statewide reporting system for this information. The Department anticipates that at least two full-time positions would be necessary to collect data, work with municipalities, build and maintain the reporting system, and produce the required annual report and would cost between $100,000 and $500,000. The Department did not provide specific positions to be authorized or specific appropriation amounts needed to administer this bill.
