STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty-Six

 

AN ACT prohibiting certain tax dollars from being donated to non-profit organizations.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Towns, Cities, Village Districts, and Unincorporated Places; Powers and Duties of Towns; Prohibition on Certain Donations.  Amend RSA 31 by inserting after section 9-d the following new section:  

31:9-e  Prohibition on Certain Donations.  

I.  No city, town, village district, or unincorporated place shall appropriate or expend any taxpayer funds, whether through a budget or warrant article, to donate such funds to any non-profit organization.  This prohibition shall apply to all taxpayer funds, including general funds, reserve funds, and all other types of public funds.  

II.  The prohibition under paragraph I shall not apply to funds explicitly allocated to provide grants or financial assistance to non-profit organizations through a competitive bidding process, provided that such grants or assistance serve a clear public purpose and are in compliance with applicable state and federal laws and regulations.  

III.  Nothing in this section shall be interpreted to disqualify any nonprofit or any not-for-profit from entering into contracts for goods and services which would reasonably be provided through contracts or bidding processes.  Such goods and services shall be quantifiable and verifiable provided as they would be for any other contracted agency.  

2  Effective Date.  This act shall take effect 60 days after its passage.
