AN ACT relative to the issuance of subpoenas in administrative proceedings.

This bill allows for all parties to an administrative proceeding to subpoena witnesses and documents.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty-Six

 

AN ACT relative to the issuance of subpoenas in administrative proceedings.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Administrative Procedure Act; Rules for Adjudicatory Proceedings.  Amend RSA 541-A:30-a by inserting after paragraph VIII the following new paragraph:  

IX.  All parties to every proceeding under this chapter and any other administrative hearing held pursuant to law shall have equal authority to subpoena witnesses or documents, and that authority  shall be identical to the authority set forth in RSA 516:2 through RSA 516:4.  

2  Effective Date.  This act shall take effect January 1, 2027.
