1 New Section; Teacher Bill of Rights; Established. Amend RSA 189 by inserting after section 42 the following new section:

189:42-a Teacher Bill of Rights.

I. For the purposes of this section, "teacher" means every person employed as a teacher or instructor in public schools or public chartered schools to provide instruction in a classroom or in a career and technical education setting on subjects pursuant to RSA 193-E:2-a and RSA 188-E.

II. All teachers' rights are reserved to teachers without the obstruction or interference from any school. These rights include:

(a) A safe and healthy school environment, which shall:

(1) Facilitate constructive working relationship between teachers and administrators;

(2) Be free from acts of violence; and

(3) Promote overall cleanliness on school grounds, buildings, common areas, and individual rooms.

(b) To be treated with civility and respect;

(c) To be provided a safe, caring, orderly environment, in which the school district shall expect civility from all who engage in school activities including mutual respect, professionalism and common courtesy;

(d) To be free to share information regarding a student's educational experience, health, or safety with the student's parent or legal guardian unless otherwise prohibited by state law or the federal Family Educational Rights and Privacy Act of 1974 (FERPA);

(e) To be allowed to appropriately discipline students where such discipline is permitted by the school board pursuant to RSA 189:15;

(f) To have their professional judgment and discretion respected by their school and its administrators with respect to any disciplinary action taken by that teacher in accordance with school and district policy;

(g) To be free from retaliation by administration, but not to include disciplinary actions taken by administration in accordance with school and district policy;

(h) To freely communicate with and be allowed to request the participation of parents in appropriate student discipline decisions;

(i) To have their authority respected which is essential to creating an environment conducive to learning, effective instruction in the classroom, and proper administration of public schools; and

(j) To report any errant, offensive, or abusive content or behavior of students to school officials or appropriate agencies.

III. Each public school district and board of trustees of a chartered public school shall post on its website a copy of the Teacher Bill of Rights as stated in paragraph II.

2 Effective Date. This act shall take effect upon its passage.
