AN ACT relative to the inter-agency data sharing for the purpose of distributing summer electronic benefit transfer (EBT) benefits.

This bill directs the department of education and department of health and human services to enter into a memorandum of understanding to enable the department of education to share student addresses with the department of health and human services for the purpose of administering the federal Summer EBT program.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty-Six

 

AN ACT relative to the inter-agency data sharing for the purpose of distributing summer electronic benefit transfer (EBT) benefits. 

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraphs; Student Privacy; Limited Data Sharing for the Purpose of Administering Summer EBT.  Amend RSA 189:68 by inserting after paragraph V the following new paragraphs:  

VI.  To facilitate data sharing between the department of education and the department of health and human services, the department of education shall include on all forms in all formats that collect information the following question with a check box or initial line affirming or denying data sharing:  

"I would like the department of education to share my address with the department of health and human services only for the purpose of my child/children receiving Summer EBT.  Yes ___ No ___

The department of education shall interpret a failure to mark or initial either "yes" or "no" as a family denying data sharing."  

VII.  Notwithstanding RSA 189:68, I(b), the department of education shall enter into a memorandum of understanding (MOU) with the department of health and human services regarding the collection and maintenance of student addresses whose parents have opted in to data sharing pursuant to paragraph VI for the purpose of administering the Summer EBT program pursuant to RSA 161:2, XIII-c.  Data collected and transmitted under this paragraph shall be confidential, be used exclusively for the administration and distribution of Summer EBT benefits, and not be used for any other purpose.  The departments shall delete any data received under the MOU upon the completion of the distribution of benefits for the corresponding summer period, unless otherwise required by federal law.

2  Effective Date.  This act shall take effect upon its passage.

AS INTRODUCED

 

AN ACT relative to the inter-agency data sharing for the purpose of distributing summer electronic benefit transfer (EBT) benefits. 

 

FISCAL IMPACT:

The Department of Health and Human Services states this bill will have no fiscal impact, as it already has a memorandum of understanding with the Department of Education relative to implementation of the Summer EBT program.
