Amendment to SB 416
Amend the bill by replacing section 2 with the following:
2 Tip Pooling. RSA 279:26-b is repealed and reenacted to read as follows:
279:26-b Tip Pooling. Notwithstanding any other provision of this chapter, the pooling and sharing of tips by employees shall be governed by the provisions of the Fair Labor Standards Act of 1938, as amended (29 U.S.C. section 201 et seq.), and regulations promulgated under such act, including but not limited to 29 C.F.R. sections 531.50, 531.52, and 531.54, as amended.
