ANALYSIS
This bill:
I. Changes the retirement age for both the adjutant general and deputy adjutant general from 65 to 64.
II. Changes the adjutant general's tenure from the age cap alone to 5 years or upon reaching the new age cap of 64.
III. Creates a new appointment process for the commandant of the New Hampshire veterans' home.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty-Six
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 The Adjutant General. Amend RSA 110-B:8, I to read as follows:
I. The adjutant general shall be appointed as provided in the constitution and the tenure of office shall be for 5 years or until the officer has reached the age of [65] 64 years. At the time of appointment, the adjutant general shall have had not less than 5 years of service as a member of the New Hampshire national guard[, immediately] preceding [that] appointment, shall have attained at least the rank of colonel and shall be eligible for federal recognition by the department of defense as a brigadier general. After one year as a brigadier general, the adjutant general may be appointed to the rank of major general. The adjutant general's salary shall be prescribed by law.
2 Deputy Adjutant General Age Limit. Amend the introductory paragraph of RSA 110-B:8-b to read as follows:
110-B:8-b Deputy Adjutant General.
The deputy adjutant general shall be appointed as provided in the constitution and the tenure of office shall be for 4 years or until the officer has reached the age of [65] 64 years. At the time of appointment, the deputy adjutant general shall have had at least 5 years of service as a member of the New Hampshire national guard or United States armed forces[,] preceding the appointment and shall have at least attained the rank of major. The deputy adjutant general's salary shall be prescribed by law. The deputy adjutant general shall:
3 Commandant and Employees. RSA 119:6 is repealed and reenacted to read as follows:
119:6 Commandant and Employees.
I. The commandant of the New Hampshire veterans’ home shall be nominated by the board of managers of the veterans’ home and shall be appointed by the governor and council for a term of 4 years.
II. The commandant shall serve as the chief executive officer of the home and shall carry out such duties as prescribed by law and as may be established by the board of managers, the commissioner of the department of military affairs and veterans services, and the governor and council.
III. Vacancies shall be filled in the manner provided for the original appointment for the unexpired term.
IV. Honorably discharged veterans as defined in RSA 119:1 shall have preference for employment in the home if qualified by the New Hampshire division of personnel.
4 Effective Date. This act shall take effect 60 days after its passage.
