AN ACT relative to enabling alternative treatment centers to operate a greenhouse cultivation location.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty-Six

 

AN ACT relative to enabling alternative treatment centers to operate a greenhouse cultivation location.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1 ?New Paragraph; Use of Cannabis for Therapeutic Purposes; Alternative Treatment Centers; Greenhouse Cultivation. ?Amend RSA 126-X:7 by inserting after paragraph X the following new paragraph:

XI.  Each alternative treatment center registered under this section may request authorization to operate a greenhouse cultivation location, at the same or at a different location than its existing cultivation location, in order to reduce energy costs and provide lower prices for registered qualifying patients.

(a)  The department shall adopt rules, pursuant to RSA 541-A, which:

(1)  Allow alternative treatment centers to apply for authorization to conduct greenhouse cultivation; and

(2)  Are necessary to regulate the operation of greenhouse cultivation, including rules regarding location and security.

(b)  An alternative treatment center requesting authorization to operate a greenhouse cultivation location shall submit a detailed proposal to the department, pursuant to rules adopted under this section and RSA 541-A, which shall include the alternative treatment center’s plan to reduce energy costs and provide lower prices for registered qualifying patients.

(c)  A greenhouse cultivation location shall also be subject to rules adopted by the department under RSA 126-X:6, III, and all applicable provisions of this chapter, including, but not limited to, compliance with local zoning laws.

(d)  The department shall, in conjunction with the local governing body of the town or city where the greenhouse cultivation location would be located, solicit input from qualifying patients, designated caregivers, and residents of the town or city in which the greenhouse cultivation location would be located.

(e)  Any alternative treatment center which operates a greenhouse shall include in its annual report to the department, required by RSA 126-X:8, XII, the impacts of greenhouse cultivation on energy costs and product prices. The department shall include this information in its annual report required under RSA 126-X:10, V.
