AN ACT relative to the composition of the board of dental examiners and relative to temporary licenses for out-of-state professionals.

ANALYSIS

 

This bill:

 

I.  Mandates that one member of the board of dental examiners be a general dentist.

 

II.  Extends the rulemaking authority of the office of professional licensure and certification as it relates to the issuance of temporary licenses for out-of-state professionals from health care professionals to any profession regulated by a board or the office.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty-Six

 

AN ACT relative to the composition of the board of dental examiners and relative to temporary licenses for out-of-state professionals.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Dentists and Dentistry; Examining Board; Membership.  Amend RSA 317-A:2, I to read as follows:

I. There shall be a board of dental examiners consisting of 9 members,[;] including 6 dentists, 2 dental hygienists, and one public member, each to be appointed by the governor, with the approval of the council, to a term of 5 years. One dentist member shall have a current permit to administer general anesthesia and deep sedation, and one dentist member shall be a general dentist. No member of the board shall be appointed to more than 2 consecutive terms. Only board members provided for in this paragraph shall have the authority to vote in board determinations.

2  Office of Professional Licensure and Certification; Rulemaking Authority.  Amend RSA 310:6, V to read as follows:

V. Temporary licenses to out-of-state [health care] professionals who present evidence of an active license in good standing from another jurisdiction in a profession regulated by a board or the office. The temporary license shall be valid for 120 days, or until the office acts on an application for full licensure, whichever happens first, and shall not be renewed, except that a complete application for full licensure before the expiration of the temporary license shall continue the validity of the temporary license until the office has acted on the application. All individuals licensed under rules adopted pursuant to this subparagraph shall be subject to the jurisdiction of the state licensing body for that profession.

3  Effective Date.  

I. Section 1 of this act shall take effect September 1, 2026.

II. The remainder of this act shall take effect upon its passage.

AS INTRODUCED

FISCAL IMPACT:

The Legislative Budget Assistant has determined that this legislation has a total fiscal impact of less than $10,000 in each of the fiscal years 2026 through 2029.
