STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty-Six

 

AN ACT directing the department of education to create an education funding transparency data and reporting system.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Education; The State School Organization; Funding Data and Transparency Reporting System.  Amend RSA 186 by inserting after section 77 the following new section:

186:77-a  Funding Data and Transparency Reporting System.

I.  The department of education shall create an education funding data and transparency reporting system (system).  The system shall include a longitudinal data system incorporating, at a minimum, data on basic education funding allocations, disbursements, and expenditures over the past 10 years disaggregated at the intermediate unit, district, and school levels.  The department shall create data visualization dashboards to simulate changes to the funding formula, including changing weights and measures of funding allocations and distributions of funds based on school characteristics.  Data visualization dashboards shall be accessible to the appropriate staff at state entities, including the legislature and governor's office.

II.  The education funding data and transparency reporting system shall:  

(a)  Be agnostic regarding data type and capable of accessing and integrating any data type from any data system across participating feeder systems from partner entities;

(b)  Have advanced data management capabilities to clean and prepare data, create master records, and flag any errors or missing data;

(c)  Have automated data governance capabilities to audit and track the lineage of data edits and changes made by different authorized users;

(d)  Have advanced analytics functionality, including data mining and machine learning capabilities to analyze the longitudinal data for program evaluation, predictive analytics for forecasting and projections into the future, and natural language processing for allowing partner entities to analyze large volumes of text found in surveys, grants, accreditation reports, and other text-heavy documents;

(e)  Have business intelligence capabilities for partner entities to easily generate reporting and visualizations through a low code or no code drag and drop interface;

(f)  Include public-facing dashboards that only include aggregate-level data that is appropriate for the general public to view;

(g)  Include restricted dashboards and environments for partner entities to view data that is subject to the protections of 20 U.S.C. § 1232, with role-based permissions;

(h)  Support data exchanges and interoperability with the department of education, general court, governor's office, and other existing data systems in this state to be identified by the department; and

(i)  Ensure routine and ongoing compliance with 20 U.S.C. § 1232g and other relevant privacy laws and policies by:

(1)  Using de-identified data in data research and public reporting;

(2)  Implementing established policies regarding small cell suppression;

(3)  Disposing of information that is no longer needed;

(4)  Providing data security, including the capacity for audit trails;

(5)  Performing regular audits for compliance with data privacy and security standards; and

(6)  Implementing guidelines and policies that prevent the reporting of any potentially identifiable data.

III.  The sum of $500,000 for the fiscal year ending June 30, 2027, and for every year thereafter, is hereby appropriated to the department of education for the purpose of operating and maintaining an education funding transparency data and reporting system.  These funds shall be nonlapsing.  The governor is authorized to draw a warrant for said sums out of any money in the treasury not otherwise appropriated.

2  Appropriation; Funding Data and Transparency Reporting System.  The sum of $900,000 for the fiscal year ending June 30, 2027 is hereby appropriated to the department of education for the purpose of creating an education funding transparency data and reporting system.  These funds shall be nonlapsing.  The governor is authorized to draw a warrant for said sums out of any money in the treasury not otherwise appropriated.

3  Effective Date.  This act shall take effect July 1, 2026.

SB 583-FN- FISCAL NOTE

AS INTRODUCED

 

AN ACT directing the department of education to create an education funding transparency data and reporting system.

 

FISCAL IMPACT:

The Office of Legislative Budget Assistant is unable to complete a fiscal note for this bill as it is awaiting information from the Department of Education.  The Department was initially contacted on  10/14/25 for a fiscal note worksheet, with follow-up contact made on 12/5/25.  When completed, the fiscal note will be forwarded to the Senate Clerk's Office.
