STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty-Six
AN ACT relative to the offense of identity fraud.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Identity Fraud; Definitions. Amend RSA 638:25 to read as follows:
638:25 Definitions.
In this subdivision:
I. "Entity" means any corporation, limited liability company, trust, partnership, incorporated or unincorporated association or organization, and any other legal entity or combination of entities, including any state, county, or municipal government and any subdivision, branch, department, or agency thereof.
II. "Personal identifying information" means any name, number, or information that may be used, alone or in conjunction with any other information, to assume the identity of an individual or entity, including any name, address, telephone number, driver's license number, social security number, employer or place of employment, employee identification number, mother's maiden name, demand deposit account number, savings account number, credit card number, debit card number, personal identification number, account number, [or] computer password identification, or logo or other mark used to identify an entity.
[II.] III. "Pose" means to falsely represent oneself, directly or indirectly, as another person or persons, or entity or entities.
[III.] IV. "Victim" means any person or entity whose personal identifying information has been unlawfully obtained or recorded or any person or entity that provided money, credit, goods, services, or anything of value and has suffered financial loss as a direct result of the commission or attempted commission of a violation of this subdivision.
2 Identity Fraud. Amend RSA 638:26, I to read as follows:
I. A person is guilty of identity fraud when the person:
(a) Poses as another person or entity with the purpose to defraud in order to obtain money, credit, goods, services, or anything else of value;
(b) Obtains, [or] records, or uses personal identifying information about another person or entity without the express authorization of such person or entity, with the intent to pose as such person or entity;
(c) Obtains, [or] records, or uses personal identifying information about a person or entity without the express authorization of such person or entity in order to assist another to pose as such person or entity; or
(d) Poses as another person or entity, without the express authorization of such person or entity, with the purpose of obtaining confidential information about such person or entity, or another person or entity, that is not available to the general public.
3 Effective Date. This act shall take effect January 1, 2027.
