Amendment to SB 626-FN

 

Amend the title of the bill by replacing it with the following:  

 

AN ACT restricting right-to-know requests to New Hampshire citizens.

 

Amend the bill by replacing sections 1 and 2 with the following:  

 

1  New Paragraph; Public Officers and Employees; Access to Government Records and Meetings; Definitions.  Amend RSA 91-A:1-a by inserting after paragraph I the following new paragraph:  

I-a.  “Citizen”  means a person who is domiciled or owns property, or both, in this state and in any city, town, or other political subdivision of this state, which can be demonstrated by reasonable proof of domicile or property ownership analogous to the documents allowed to prove domicile pursuant to RSA 654:12, I(c).  Media requestors, as defined in RSA 91-A:4, IX, attorneys licensed to practice law in New Hampshire requesting on behalf of a client, and employees of businesses with their principal place of business in New Hampshire acting on behalf of their employer are exempt from the domicile requirements of this paragraph, except that an attorney licensed to practice law in New Hampshire who submits a request shall represent a citizen of New Hampshire.

2  Public Officers and Employees; Access to Government Records and Meetings; Minutes and Records Available for Public Inspection.  Amend RSA 91-A:4, IV(a) to read as follows:  

(a)  Each public body or agency shall, upon request by a citizen for any governmental record reasonably described, make available for inspection and copying any such governmental record within its files when such records are immediately available for such release.

This bill restricts right-to-know requests to New Hampshire citizens, subject to certain exceptions, and defines a citizen as a person domiciled or owning property in the state.
