STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty-Six

 

AN ACT establishing a voluntary surcharge program and fund for the division of the arts and state council on the arts.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Subdivision; The State and Its Government; Council on the Arts; Performance Arts Ticket Surcharge Program.  Amend RSA 19-A by inserting after section 15 the following new subdivision:

Performance Arts Ticket Surcharge Program

19-A:16  Performance Arts Ticket Surcharge Program.

I.  For purposes of this section, "performing arts venue" means a facility primarily dedicated to the presentation of the performing arts.  

II.  There is hereby established a voluntary surcharge program for New Hampshire performing arts venues, with a capacity between 100 and 2,500 persons and with ticket sellers at such venues who charge no more than $0.50 per ticket, to fund the division of the arts and the New Hampshire state council on the arts.  The surcharge shall be administered by the department of natural and cultural resources and deposited into the performance art voluntary ticket surcharge fund created in paragraph III.  The division of the arts shall be authorized, upon the approval of the commissioner of natural and cultural resources, or the approval of the governor and executive council, to make grants, or provide matching grants, to the fund.

III.  There is hereby established in the department of natural and cultural resources a performance art voluntary ticket surcharge fund, which shall be kept distinct and separate from all other funds.  All moneys in the fund shall be nonlapsing.  All moneys and interest in the performance art voluntary ticket surcharge fund shall be used for the purpose of supporting the administration, functions, and grants, including matching grants, of the division of the arts and the New Hampshire state council on the arts and shall not be used for any other purpose.

IV.  The New Hampshire state council for the arts and the division of the arts shall develop a memorandum of understanding, approved by the commissioner of natural and cultural resources, to govern voluntary participation in the performance arts ticket surcharge program.

V.  The commissioner of natural and cultural resources shall adopt rules, under RSA 541-A, regarding the establishment of the surcharge voluntary program, a memorandum of understanding, the designation of the surcharge as a charitable donation, and expenditures from the fund.

2  New Subparagraph; The State and Its Government; State Treasurer; Application of Receipts.  Amend RSA 6:12, I(b) by inserting after subparagraph (410) the following new subparagraph:

(411)  Moneys deposited into the performance art ticket surcharge fund established in RSA 19-A:16, III.

3  Effective Date.  This act shall take effect 60 days after its passage.
