STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eleven
AN ACT requiring providers of prepaid cellular telephone service to provide subscriber information to the enhanced 911 system.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Enhanced 911 System; Subscriber Information From Providers of Prepaid Cellular Telephone Service. Amend RSA 106-H by inserting after section 10 the following new section:
106-H:10-a Provision of Prepaid Telephone Subscriber Information. Each provider of prepaid commercial mobile radio service shall provide to the bureau for the purposes of helping to locate a calling party in exigent circumstances and in such format as the commissioner may require, any information in its possession related to the name, street address, city, and state of the purchaser or user of the service and the telephone number assigned to such purchaser or user sold by a provider or such provider’s agent within the state of New Hampshire. This information shall be made available by the provider or reseller of such service to the bureau at the time of request by the bureau. For purposes of this section, the term “purchaser” means the end user of the service at the retail level.
II. No provider of a prepaid commercial mobile radio service shall be held liable for failure to provide any or all of the requested information if the information is not in the provider’s possession and the provider has acted in good faith to comply with this section.
2 Effective Date. This act shall take effect January 1, 2012.
