STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT allowing companion dogs in the outdoor areas of restaurants.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Restaurant Owners; Companion Dogs. Amend RSA 466:44 by inserting after paragraph II the following new paragraph:

III. A restaurant owner may allow properly disciplined and leashed companion dogs of restaurant patrons onto any outdoor patio areas owned by the restaurant. Such dogs shall not be allowed in food preparation or production areas, and there shall be no more than one dog per patron. The restaurant owner shall prominently display a sign at all outdoor patio entrances advising patrons as follows: “To preserve the rights of patrons with service animals, patrons with companion dogs shall be asked to move if the presence of that companion dog interferes with the service animal's ability to obey commands or assist its handler.”

2 Effective Date. This act shall take effect 60 days after its passage.
