STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\testablishing a commission to evaluate the 3-tier system.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t216:1  New Section; Commission to Evaluate the 3-Tier System.  Amend RSA 175 by inserting after section 10 the following new section:

\t175:11  Commission to Evaluate the 3-Tier System.

\t\tI.  There is established a commission to evaluate the 3-tier system.

\t\tII.  The members of the commission shall be as follows:

\t\t\t(a)  One member of the senate, appointed by the president of the senate.

\t\t\t(b)  Two members of the house of representatives, appointed by the speaker of the house of representatives.

\t\t\t(c)  The liquor commissioner, or designee.

\t\t\t(d)  A representative of a wine manufacturer, appointed by the president of the senate.

\t\t\t(e)  A representative of a liquor manufacturer, appointed by the speaker of the house of representatives.

\t\t\t(f)  A representative of a beverage manufacturer, appointed by the governor.

\t\t\t(g)  Two representatives of alcoholic beverage distributors, one of whom shall be appointed by the president of the senate and one of whom shall be appointed by the governor.

\t\t\t(h)  Two representatives of alcoholic beverage retailers, one of whom shall be appointed by the speaker of the house of representatives and one of whom shall be appointed by the governor.

\t\tIII.  Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

\t\tIV.(a)  The commission shall study the separation of alcoholic beverage producers, distributors, and retailers, commonly referred to as the 3-tier system.  Specifically, the commission shall:

\t\t\t\t(1)  Review the level of separation that exists between alcoholic beverage producers, distributors, and retailers.

\t\t\t\t(2)  Make recommendations for the future of the 3-tier system, if necessary.

\t\t\t\t(3)  Review the system to see if disparities between entities exist and, if necessary, make recommendations to address them.

\t\t\t(b)  The commission shall solicit information from any person or entity the commission deems relevant to its study.

\t\tV.  The members of the commission shall elect a chairperson from among the members.  The first meeting of the commission shall be called by the senate member.  The first meeting of the commission shall be held within 45 days of the effective date of this section.  Six members of the commission shall constitute a quorum.

\t\tVI.  The commission shall report its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before December 1, 2016.

\t216:2  Repeal.  RSA 175:11, relative to the commission to evaluate the 3-tier system, is repealed.

\t216:3  Effective Date.  

\t\tI.  Section 2 of this act shall take effect December 1, 2016.

\t\tII.  The remainder of this act shall take effect upon its passage
