AMENDED ANALYSIS
This bill allows the chief medical examiner and delegates to register and access the controlled drug prescription health and safety program.
This bill also makes an appropriation to the controlled drug prescription health and safety program.
This bill is a request of the controlled drug prescription health and safety program, established in RSA 318-B:32.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eighteen
Be it Enacted by the Senate and House of Representatives in General Court convened:
158:1 New Paragraph; Controlled Drug Prescription Health and Safety Program Operation. Amend RSA 318-B:33 by inserting after paragraph II-a the following new paragraph:
II-b. The chief medical examiner and delegates may register and access the program.
158:2 Providing Controlled Drug Prescription Health and Safety Information. Amend RSA 318-B:35, I(a) to read as follows:
(a) By electronic or written request to prescribers [and], dispensers, and the chief medical examiner and delegates within the state who are registered with the program:
(1) For the purpose of providing medical or pharmaceutical care to a specific patient; [or]
(2) For reviewing information regarding prescriptions issued or dispensed by the requester[.]; or
(3) For the purpose of investigating the death of an individual.
158:3 Repeal. RSA 318-B:35, I(c)(3), relative to information to the chief medical examiner, is repealed.
158:4 Appropriation. There is hereby appropriated an amount equal to 5 percent of the revenue collected on behalf of the following boards for the biennium ending June 30, 2019 to the controlled drug prescription health and safety program established under RSA 318-B:32: pharmacy board, board of medicine, board of nursing, board of dental examiners, board of veterinary medicine, naturopathic board of examiners, board of podiatry, and the board of registration in optometry. The commissioner of the department of administrative services shall determine such amount. The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.
158:5 Effective Date. This act shall take effect 60 days after its passage.
