AN ACT relative to notification of security breaches.

This bill provides that following the initial notice of a security breach, further information regarding the breach may be withheld pending a criminal investigation.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty

 

AN ACT relative to notification of security breaches.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Notice of Security Breach.  RSA 359-C:20, II is repealed and reenacted to read as follows:

II.  After providing initial notice of a security breach pursuant to paragraph I, additional information regarding the breach may be withheld if a law enforcement agency, or national or homeland security agency, determines that disclosure will impede a criminal investigation or jeopardize national or homeland security.  Such information shall be provided upon completion of the investigation or determination that disclosure no longer presents a threat to national or homeland security.

2  Effective Date.  This act shall take effect 60 days after its passage.
