STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Three
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Communicable Disease; Immunization. Amend RSA 141-C:20-a, I to read as follows:
I. All parents or legal guardians shall have their children who are residing in this state immunized against [certain diseases. These diseases shall include, but not be limited to,] diphtheria, mumps, pertussis, poliomyelitis, rubella, rubeola, and tetanus. [The commissioner shall adopt rules under RSA 541-A relative to other diseases which require immunization.] The rules adopted by the commissioner requiring varicella, Hepatitis B, and Haemophilus influenzae type B (Hib) vaccinations shall remain in effect until their regular expiration date of June 30, 2026.
2 Repeal. RSA 141-C:6, XIII, relative to rulemaking for other communicable diseases under RSA 141-C:20-a, I.
3 Effective Date. This act shall take effect 60 days after its passage.

AN ACT relative to the department of health and human services' rulemaking authority regarding immunization requirements.
FISCAL IMPACT:
The Office of Legislative Budget Assistant is unable to provide a fiscal note for this bill, as introduced, as it is awaiting information from the Department of Health and Human Services. The Department was contacted on 12/19/22. When completed, the fiscal note will be forwarded to the House Clerk's Office.
