STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Three

 

AN ACT relative to the department of health and human services' rulemaking authority regarding immunization requirements.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Communicable Disease; Immunization.  Amend RSA 141-C:20-a, I to read as follows:

I.  All parents or legal guardians shall have their children who are residing in this state immunized against [certain diseases.  These diseases shall include, but not be limited to,] diphtheria, mumps, pertussis, poliomyelitis, rubella, rubeola, and tetanus.  [The commissioner shall adopt rules under RSA 541-A relative to other diseases which require immunization.]  The rules adopted by the commissioner requiring varicella, Hepatitis B, and Haemophilus influenzae type B (Hib) vaccinations shall remain in effect until their regular expiration date of June 30, 2026.

2  Repeal.  RSA 141-C:6, XIII, relative to rulemaking for other communicable diseases under RSA 141-C:20-a, I.

3  Effective Date.  This act shall take effect 60 days after its passage.

AN ACT relative to the department of health and human services' rulemaking authority regarding immunization requirements.

 

FISCAL IMPACT:

The Office of Legislative Budget Assistant is unable to provide a fiscal note for this bill, as introduced, as it is awaiting information from the Department of Health and Human Services.
