STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Four
AN ACT prohibiting a person from membership on the school board and select board concurrently.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Incompatibility of Offices; Select Board and School Board. Amend RSA 669:7 by inserting after paragraph I-a the following new paragraph:
I-b. No person shall declare candidacy or simultaneously be nominated for election or appointment to hold positions on any school board and the select board or other local municipal governing body in the jurisdiction of the person's residence.
2 Application; Enforcement. Anyone holding such simultaneous positions as described in RSA 669:7, I-b as inserted by section 1 of this act, shall immediately resign from one such position. The vacant position may be filled temporarily by appointment with a majority vote of the remaining members. Such appointee shall serve until the next election. If a majority of the members making the temporary appointment are unable to agree on a appointee, the position may be filled by an appointment made by the chair of said board. In the case of an appointment made by the chair, said person may only serve a maximum of one year. If the remaining term is greater than one year until the next regular municipal election, in the case of an appointment made by the chair, a special election shall be held. The attorney general may enforce this section by bringing a suit against any person refusing to abandon one of the 2 positions and a court may order the person to vacate one of the positions and asses costs to reimburse the attorney general.
3 Effective Date. This act shall take effect January 1, 2025.
