AMENDED ANALYSIS

 

This bill updates certain language regarding information collected by hospitals on the birth worksheet; revises the intervals for reporting Apgar scores; and states that the division of vital records shall not include certain personally identifiable information in the birth information released to the CDC.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Five

 

AN ACT relative to the collection of birth worksheet information.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Vital Records Administration; Completion of Birth Worksheet.  Amend RSA 5-C:19, II(a)(3)(A) to read as follows:

(A)  Current name and [maiden] name prior to first marriage or civil union.

2  Vital Records Administration; Completion of Birth Worksheet.  Amend RSA 5-C:19, II(a)(6)(L) to read as follows:

(L)  The Apgar score, which is an evaluation of a newborn infant's physical status, at one minute, [and] at 5 minutes, and at 10 minutes.

3  New Paragraph; Vital Records Administration; Completion of Birth Worksheet.  Amend RSA 5-C:19 by inserting after paragraph XI the following new paragraph:

XII.(a)  When the division of vital records administration releases information on a birth to the Centers for Disease Control (CDC), it shall not include:

(1)  The names of the mother, father, or baby;

(2)  The birth month and day of the mother or father;

(3)  Their medical record numbers; or

(4)  Their residential address, mailing address if different from the residential address, or zip code.

(b)  Notwithstanding subparagraph (a)(2), the division may release the mother and father's birth year and the baby's birth date to the CDC.

4  Effective Date.  This act shall take effect June 30, 2026.

METHODOLOGY:

This bill amends certain language regarding information collected by hospitals on the birth worksheet that the Division of Vital Records is authorized to share with the Centers for Disease Control (CDC.

 

The Department of State indicates the Division of Vital Records currently receives $168,000 annually in federal funds from the CDC for birth and death statistics.  This amount is deposited into the Vital Records Improvement Fund.  Of this funding, $75,600 (or 45%) is allocated for birth-related activities.  According to the CDC, failure to provide this information may result in New Hampshire receiving only 10% of the birth funding in the future, translating to a potential loss of $68,000 per year.  Given the CDC's use of the term "may," the Department cannot precisely determine the fiscal impact.  Furthermore, the bill could impact the funding the division receives from DHHS through federal grants.

 

The Department of Health and Human Services states that if the Department cannot receive essential data elements, such as the mother's date of birth, it may lead to conflicts with reporting requirements and uncertainties regarding the recording of birth records, potentially impacting programs and public services for New Hampshire residents, including maternal and child health programs and federal funding.
