ANALYSIS
This bill modifies the state building code provisions and school construction aid statutes to extend full building code compliance and state-funded construction aid eligibility to chartered public schools on the same basis as traditional public schools.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty-Six
AN ACT relative to public charter schools and the state building code and governmental land use exemptions.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 State Building Code. Amend RSA 155-A:2, I to read as follows:
I. All buildings, building components, and structures constructed in New Hampshire shall comply with the state building code and state fire code. The construction, design, structure, maintenance, and use of all buildings or structures to be erected and the alteration, renovation, rehabilitation, repair, removal, or demolition of all buildings and structures previously erected shall be governed by the provisions of the state building code. The state building code in effect at the time that the application for the building permit required by RSA 155-A:4 is received by the governing authority shall remain in effect for the duration of the work covered by that permit. This requirement notwithstanding, for a period of 6 months after the effective date of the code adopted under RSA 155-A:1, IV, a concurrency period is established, allowing building permits, and other required documents, at the election of the applicant, to show compliance using either the code in effect just prior the effective date of the code adopted under RSA 155-A:1, IV, or the code adopted under RSA 155-A:1, IV, but not a combination of the 2 codes. For purposes of this section, "public school building" includes facilities owned, operated, or occupied by public charter schools established under RSA 194-B.
2 Building Requirements for State Funded Buildings. Amend RSA 155-A:13, II(e) to read as follows:
(e) Public school facilities, including public charter schools established under RSA 194-B, that are subject to RSA 198:15-c.
3 Amount of Grant. RSA 198:15-b, I(b)(3) is repealed and reenacted to read as follows:
(b)(3) The amount of the grant to any chartered public school established in accordance with RSA 194-B:3-a shall be calculated and disbursed in the same manner as a grant to a school district under subparagraphs (1) and (2). Chartered public schools shall be eligible for the same percentage of eligible construction costs, and the same schedule of state disbursement, as provided to school districts for eligible school construction projects under this section.
4 Effective Date. This act shall take effect 60 days after its passage.
