STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty-Six
AN ACT relative to military orders of protection.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Notification; Domestic Violence Protective Orders; Military Protective Orders; Violations. Amend RSA 173-B:8 by inserting after paragraph III the following new paragraph:
IV. If a law enforcement officer or peace officer has probable cause to believe a member of the armed forces is in violation of a military protection order, as defined in RSA 173-B:1, entered into the Federal Bureau of Investigation’s National Crime Information Center database, the law enforcement officer shall notify the law enforcement agency that entered the military protection order into the database that the service member may have violated the military protection order.
2 Military Protective Orders; Violation; Notification. Amend RSA 110-B:19-a to read as follows:
110-B:19-a National Guard and Staff Judge Advocate; Access to Criminal History Records.
I. The New Hampshire [Air National Guard] air national guard, New Hampshire [Army National Guard] army national guard, and 157 Air Refueling Wing Offices of the Staff Judge Advocate shall be granted access to all confidential criminal history records, criminal investigation documentation, and public court records of New Hampshire [National Guard] national guard employees and service members for the purpose of carrying out the office's responsibilities and the respective attorneys' duties under state, federal, and military law and regulations.
II. If a law enforcement officer or peace officer has probable cause to believe a member of the New Hampshire air national guard or New Hampshire army national guard is in violation of a military protection order, the law enforcement officer or peace officer shall notify the office of the New Hampshire national guard general counsel that the service member may have violated the military protective order.
3 Effective Date. This act shall take effect 180 days after passage.
