AN ACT  limiting consumer access to certain high-risk rodenticides.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty-Six

 

AN ACT  limiting consumer access to certain high-risk rodenticides.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Subdivision; Rodenticide Sales Restrictions.  Amend RSA 430 by inserting after section 58 the following new subdivision:  

Rodenticide Sales Restrictions

430:59  Applicability.  This subdivision shall apply to any pesticide product containing one or more of the following active ingredients:  brodifacoum, bromadiolone, difethialone, difenacoum, warfarin, chlorophacinone, diphacinone, bromethalin, cholecalciferol, or zinc phosphide, or any additional active ingredient designated by rule of the commissioner under RSA 541-A.

430:60  Sales Restricted.

I.  No person shall distribute, sell, or offer for sale any rodenticide product containing an active ingredient listed in RSA 430:59 to any purchaser in New Hampshire without first verifying the purchaser’s status as:

(a)  A certified applicator licensed under RSA 430; or

(b)  A private applicator or commercial agricultural operation registered with the department.

II.  Verification shall be documented at the point of sale, whether in-person, online, or through any remote sales channel.  Distributors and retailers shall maintain records of verification for not less than 3 years.

III.(a)  No rodenticide product covered by this section shall be sold via internet, catalog, or remote sales to any purchaser in New Hampshire unless the seller verifies the purchaser’s license or registration status under paragraph I.

(b)  Online marketplaces shall be prohibited from listing such products for direct-to-consumer sale without license verification.

430:61  Penalties.

I.  The department of agriculture, markets, and food, the state police, and other law enforcement agencies shall have authority to investigate, enforce, and penalize violations of this section, including unlawful internet or cross-border sales.

II.  Any violation of this subdivision shall be subject to a civil penalty not exceeding $5,000 per violation.  Each day a violation continues shall constitute a separate offense.

2  Effective Date.  This act shall take effect January 1, 2027.
