This bill:

 

I.  Prohibits public schools from performing surgical procedures or prescribing pharmaceutical drugs.

 

II.  Requires a health care facility to provide certified, written notice to a critical access hospital if the facility will be located within a 15 mile radius of the critical access hospital.

 

III.  Allows youth camps licensed under this chapter to administer pharmaceutical drugs to minors with the written authorization of a parent or guardian.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Five

 

AN ACT prohibiting public schools from performing surgical procedures or prescribing pharmaceutical drugs, relative to licensing requirements for health care facilities established within a 15 mile radius of a critical access hospital, and relative to the administration of prescription medication to minors by youth camp staff.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  School Health Services; Prohibitions.  Amend RSA 200:27 to read as follows:

200:27 School Health Services.

I. The local board in each school district may provide school health services to include school nurse services and school physician services to every child of school age in the district, as hereinafter provided.

II.  Nothing in this section shall allow any school physician or nurse, or other health care provider employed or contracted by the school district, to perform surgical procedures or prescribe pharmaceutical drugs on school grounds.

2  Residential Care and Health Facility Licensing; License or Registration Required.  RSA 151:4-a, II(a) is repealed and reenacted to read as follows:  

II.(a)  Any person or entity proposing to establish an ambulatory surgical center, emergency medical care center, hospital, birthing center, drop-in or walk-in care center, dialysis center, or special health care service within a radius of 15 miles of the primary physical location of a New Hampshire hospital certified as a critical access hospital pursuant to 42 C.F.R 485.610(b) and (c), shall give written notice of the intent to establish the health care facility within a 15 mile radius of the critical access hospital.  The notice shall include a description of the facility and any health care services to be established and shall be sent by certified mail to the chief executive of the critical access hospital.

3  New Section; Child Day Care, Residential Care, and Child-Placing Agencies; Residential Care and Child-Placing Agency Licensing; Administration of Prescribed Medication.  Amend RSA 170-E by inserting after section 30 the following new section:  

170-E:30-a  Administration of Prescribed Medication.  Notwithstanding any provision of law to the contrary, any youth camp licensed under this chapter may administer a pharmaceutical drug to a minor pursuant to a valid prescription issued by a licensed health care provider, including a provider licensed in another state, with the written authorization of a parent or legal guardian.

4  Effective Date.  

I.  Section 1 of this act shall take effect 60 days after its passage.

II.  The remainder of this act shall take effect upon its passage.
