STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty-Six

 

AN ACT relative to requirements for law enforcement officers assisting in immigration enforcement.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Short Title.  This act may be known as and cited to as the "Granite State No Anonymity in Immigration Enforcement Act".  

2  New Section; Participation in Federal Immigration Officers; Requirements for Law Enforcement Officers.  Amend RSA 106-P by inserting after section 1 the following new section:  

106-P:2  Requirement for Law Enforcement Officers.  

I.  Any state or local law enforcement officer who is assisting the United States Immigration and Customs Enforcement pursuant to the federal 287(g) program as outlined in RSA 106-P:1 shall be required to adhere to all of the following while performing duties pursuant to a 287(g) program:  

(a)  Each officer shall clearly display either their name or their badge number.

(b)  No officer shall wear any facial covering or mask.

(c)  No officer shall disable or disengage their body-worn camera.

II.  State and local law enforcement agencies shall develop disciplinary measures for officers who do not comply with paragraph I.  

III.  All complaints alleging violation of this section shall be forwarded to the department of justice's civil rights unit for investigation.  

3  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill requires any state or local law enforcement officers assisting U.S. Immigration and Customs Enforcement personnel to display their name or badge number and prohibits those officers from wearing masks and disabling their body-worn camera and to develop disciplinary procedures for officers that fail to comply. It also requires that all complaints be forwarded to the Department’s Civil Rights Unit for investigation. This could result in an increase in demand on the Department of Justice Civil Rights Unit for investigative and attorney resources. Although the Department cannot predict how many such complaints this bill may create, the Department states that any increase beyond 3 to 5 additional complaints per year is going to require an additional investigator and attorney for the Civil Rights Unit. If the number of complaints exceeds 40, then the Civil Rights Unit may need even more additional staff. The Department did not provide specific cost estimates, but states it could be in the $100,000 to $500,000 range, per year.

 

The Department of Safety states this bill is consistent with current policy requirements of the Division of State Police. Therefore, this bill is not expected to have any impact on the Department. It is assumed any impact to comply with this bill for local and county law enforcement agencies would be negligible and costs, if any, would be absorbed within normal operating budgets.
