Floor Amendment to SB 123
Amend RSA 275:78, II as inserted by section 2 of the bill by replacing it with the following:
II. It shall be unlawful for any employer, as defined in RSA 275:4, to terminate, reduce pay for, count missed time against, or in any way take any adverse employment action against any employee for taking time off as needed to receive a COVID-19 vaccination, or to recover from symptoms associated with a COVID-19 vaccination, for a period of time not exceeding 24 work hours.
III. Paragraph I shall not apply to health care providers.

AMENDED ANALYSIS
This bill prohibits an employer from requiring that an employee or applicant for employment pay the cost of any medical test as a condition of employment. This bill also prohibits certain employers from requiring a COVID-19 vaccination that has not received final FDA approval as a condition of employment, and prohibits employers from taking employment actions against employees for taking time off as needed to receive or recover from a COVID-19 vaccination.
