STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Five

 

AN ACT relative to construction of a public pier on Hampton Beach and making an appropriation therefor.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Hampton Beach State Park Pier Fund.  Amend RSA 216-J by inserting after section 5 the following new section:

216-J:6  Hampton Beach State Park Pier Fund.  There is hereby established in the state treasury a fund to be known as the Hampton Beach State Park pier fund, which shall be kept separate and distinct from all other funds.  The fund shall be continually appropriated to the department of natural and cultural resources, division of parks and recreation, for the purpose of obtaining engineering services, siting, permitting, final design, construction, and ongoing maintenance of an accessible pier at Hampton Beach State Park.  The division shall take into consideration the recommendations and findings in the October 28, 2022, Hampton Beach New Pier Feasibility Study, conducted by the Hampton Area Chamber of Commerce and the department of natural and cultural resources, and the needs of persons with disabilities when designing and constructing the pier.  The division may accept appropriations, gifts, grants, and bequests from individuals, corporations, foundations, government agencies, and public and private organizations and institutions for deposit into the fund.  On July 1, 2035, the balance of fund shall be transfered to the state park gifts and donations account established under RSA 216-A:3-o, and used by the division for the purpose of expanding access to state parks for the disabled.

2  New Subparagraph; State Treasurer; Application of Receipts; Hampton Beach State Park Pier Fund.  Amend RSA 6:12, II(b) by inserting after subparagraph 399 the following new subparagraph:

(400)  Moneys deposited in the Hampton Beach State Park pier fund as established in RSA 216-J:6.

3  Division of Parks and Recreation; Hampton Beach State Park Pier; Appropriation.  The sum of $1 for the biennium ending June 30, 2027, is hereby appropriated to division of parks and recreation for deposit in the Hampton Beach State Park pier fund, established in RSA 216-J:6, for the purposes of constructing an accessible public pier at Hampton Beach.  The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.

4  Effective Date.  This act shall take effect July 1, 2025.

METHODOLOGY:

This bill establishes and makes a $1 appropriation to the Hampton Beach State Park pier fund, a dedicated fund to be administered by the Division of Parks and Recreation for the purpose of siting, permitting, designing, and constructing a public pier at Hampton Beach.

 

The Department of Natural and Cultural Resources indicates the bill directs the Department to consider the recommendations and findings of the Hampton Beach New Pier Feasibility Study, dated October 28, 2022.  The bill authorizes the Division to accept appropriations, gifts, grants, and bequests from individuals, corporations, foundations, government agencies, and public and private organizations and institutions for deposit into the fund.  The Department states, depending on the type of pier constructed, the cost estimates for the pier ranged from $21.7 million to $27.4 million.  This estimate from the October 2022 report included a 25% construction contingency based on the high-level stage of design and 40% inflation and assumed a 10-year time line for development, design, permitting, funding and construction.  The estimate assumed a 25-50 year life cycle for the pier, depending on the type of pier constructed.  Routine inspection and maintenance activities would be expected to occur at 5 to 10 year intervals throughout the life of the pier.  The estimates did not include emergency repairs to the structure that may caused by unanticipated storm damage.

 

The Department assumes there would be additional indeterminable annual costs for project oversight, seasonal staff, and maintenance costs not covered by the pier fund.  The Department expects such costs will be paid from the State Park Fund and would range from $10,000-$100,000.  The proposed pier is intended to serve the general public, including recreational fishermen.
