STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty-Six

 

AN ACT relative to notice and update requirements regarding state employee investigations.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Subdivision; Protective Legislation; Notice of Suspension of Public Employee.  Amend RSA 275 by inserting after section 83 the following new subdivision:

Notice of Suspension

275:84  Suspension Notice and Investigation Updates.  

I.  If any public employee is suspended with or without pay from duty, they shall receive written notice detailing the reasons for the suspension within 7 days of the suspension date.  The suspended employee shall be provided with periodic updates regarding the status of the investigation every 90 days until a final decision is made.  

II.  This section shall apply to all public employees, unless explicitly stated otherwise in a collective bargaining agreement.  

III.  For the purposes of this section:  

(a)  “Employer" means the state of New Hampshire and any of its political subdivisions.

(b)  "Public employee" or "employee" means any person employed by the state or any subdivision thereof, including, but not limited to counties, cities, towns, precincts, water districts, school districts, and school administrative units.

2  Effective Date.  This act shall take effect 90 days after its passage.
